Land records require an in-person visit or phone call in most cases. The Clerk's office has grantor/grantee index books and some computerized records. If you need to trace property ownership, the staff can help you find the right liber and page numbers. Bring the property address or the names of the parties involved.

For criminal records, use the Criminal History Record Search run by the Office of Court Administration. This covers all criminal convictions in New York courts. You need a name and date of birth, and there is a fee.

FOIL requests let you get records from any county office. Write to the Clerk or other agency and describe what you need. They have five business days to respond. The FOIL page at the Department of State explains how to file a request.

Types of Records Available

Land records make up a big part of what the Clerk files. Deeds, mortgages, mortgage discharges, easements, and liens are all recorded here. Court records include civil case files from Supreme Court and County Court, plus judgments and court orders. Business certificates and assumed name filings are also on file.

Vital records are handled separately. Birth and death certificates come from the New York State Department of Health or the local registrar. Marriage licenses are issued by the town clerk, not the County Clerk. If you need a vital record, contact the town where the event happened or the state health department.

Surrogate's Court in Schuyler County handles probate, wills, and estate matters. Family Court deals with custody, support, and juvenile matters, and those records are mostly sealed. Contact each court directly for their records. The County Clerk does not hold those files.

Property tax records and assessments are maintained by the county's Real Property Tax Service. The Clerk records property transfers and mortgages, but actual tax bills and assessment rolls come from a separate office. Each town in the county has its own assessor who sets property values. For questions about taxes on a specific parcel, contact the Real Property office or the town assessor.

FOIL and Your Right to Records

New York's Freedom of Information Law lets anyone ask for government records. You do not need to be a resident. You do not need to explain why you want the records. Just put your request in writing and send it to the right office.

The agency must respond within five business days. If they need more time, they can take up to 20 additional business days. Denials must include a reason. You can appeal to the agency head, and if that fails, the Committee on Open Government can step in. Standard FOIL copy fees are $0.25 per page.
